Case Synopsis
While shopping at a grocery store, our client slipped on water left on the floor. Although she managed to catch herself on the shopping cart and never actually fell to the ground, the sudden twisting motion caused serious injuries to her shoulder and cervical spine, ultimately requiring neck surgery.
Cases involving slips without an actual fall are often viewed skeptically because juries and insurers frequently associate serious injuries with dramatic falls. The surveillance footage in this case presented an additional challenge. While it clearly established the store’s negligence by showing the hazardous condition, it did not appear to depict a particularly severe incident.
